1. Introduction

Welcome to DataSense PH. These Terms of Service ("Terms") govern your use of our website, services, and products (collectively referred to as the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

Please read these Terms carefully before using our Services. If you do not agree with any part of these Terms, you must not use our Services. By accessing or using our Services, you represent that you are at least 18 years old or that you have the consent of a legal guardian.

2. Service Description

DataSense PH provides educational services in the field of marketing analytics, including but not limited to: courses, training programs, workshops, certifications, educational materials, and related consulting services.

Our Services may change from time to time. We reserve the right to modify, update, or discontinue any aspect of our Services at our sole discretion and without notice.

3. Registration and Account

To access certain features of our Services, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update this information as necessary to maintain its accuracy.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms or for any other reason.

4. Payment and Enrollment Terms

Course fees are as stated on our website, and all payments must be made in full before access to course materials is granted, unless a payment plan has been explicitly arranged.

All prices are in Philippine Peso (₱) and include applicable taxes unless otherwise specified. We reserve the right to modify our pricing at any time. Any price changes will not affect courses that have already been paid for.

Enrollment in courses is subject to availability. We reserve the right to cancel or reschedule courses due to low enrollment, instructor unavailability, or other unforeseen circumstances.

Refund Policy: Full refunds are available if requested in writing at least 14 days before the course start date. 50% refunds are available if requested between 14 and 7 days before the course start date. No refunds are available within 7 days of the course start date or after the course has begun.

5. Intellectual Property

All content, materials, and intellectual property provided as part of our Services, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, are the property of DataSense PH or its content suppliers and are protected by intellectual property laws.

You may access and use our course materials for personal, non-commercial educational purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our materials without our express written permission.

Recording of classes, whether audio, video, screenshots, or any other form, is strictly prohibited without our express written permission.

6. User Conduct

When using our Services, you agree not to:

Violate any applicable laws or regulations
Infringe the intellectual property or other rights of third parties
Interfere with or disrupt the Services or servers or networks connected to the Services
Attempt to gain unauthorized access to any part of the Services
Use the Services for any illegal or unauthorized purpose
Engage in any harassing, offensive, or harmful behavior toward other users or staff
Share your account credentials or course access with others
Engage in any activity that could damage, disable, or overburden the Services

We reserve the right to remove any content that violates these terms or that we find objectionable for any reason, and to suspend or terminate access to our Services for users who violate these terms.

7. Limitation of Liability

To the maximum extent permitted by law, DataSense PH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Your use of or inability to use our Services
Any unauthorized access to or use of our servers and/or any personal information stored therein
Any interruption or cessation of transmission to or from our Services
Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party

In no event shall our total liability to you for all claims exceed the amount you have paid to us for the Services during the 12 months preceding the event giving rise to the liability.

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that:

The Services will meet your specific requirements
The Services will be uninterrupted, timely, secure, or error-free
The results that may be obtained from the use of the Services will be accurate or reliable
The quality of any products, services, information, or other material purchased or obtained through the Services will meet your expectations
